Ms. Chmelka specializes in advising and representing employers in all aspects of labor and employment law, including harassment, discrimination, retaliation, wage and hour, and breach of contract litigation and counseling. Ms. Chmelka represents employers in state and federal court as well as matters before administrative agencies, such as the California Labor Commissioner, the California Department of Fair Employment and Housing, and the Equal Employment Opportunity Commission.
Ms. Chmelka is admitted to practice before all California state and federal courts. Ms. Chmelka also provides counseling to employers which includes advice regarding wage and hour issues and compliance; development, drafting and review of personnel policies and handbooks; personnel decisions such as hiring/firing and performance-related personnel actions; comprehensive diversity management; and harassment training.
In addition to her employment and labor practice, Ms. Chmelka also represents contractor clients in construction defect / property damage disputes, contract negotiations and liens, and environmental/mold litigation. Prior to joining Gates, Gonter, Guy, Proudfoot & Muench LLP in February 2010, Ms. Chmelka was a shareholder at Klinedinst PC, where she practiced since 1997.
